Terms of service

These terms govern your use of DutyDelta, operated by Black Ember Labs (“we”). By opening an account you agree to them.
What the service does
DutyDelta monitors published United States tariff sources — the Harmonized Tariff Schedule of the United States, the Federal Register, and CBP CSMS messages — and tells you when a change touches a tariff classification you have asked us to watch. Every item we report cites the official document it came from and links to it.
What the service is not
DutyDelta is an information service, not customs, legal, or tax advice. We are not a licensed customs broker and we do not advise on classification, valuation, origin, or admissibility. Nothing we send you is a substitute for your own professional judgement or for the official record.
We cite the official source on every line precisely so it can be checked. Verify against that source before advising a client or filing an entry. Government publication can be delayed, amended, corrected, or withdrawn, and a source can be unreachable. We do not warrant that our coverage is complete or uninterrupted, and we are not liable for decisions taken on our output without reference to the cited source.
Your account
Keep your login credentials to yourself; you are responsible for what happens under your account. The classification data you upload stays yours — we process it only to provide the service, as described in our privacy policy.
Reports you generate are published at an unguessable link so you can forward them to your client. Anyone holding that link can open the report, so treat it as you would the document itself.
Billing
The Broker plan is billed at $159 per month in advance through Stripe. The subscription renews automatically each month until you cancel. Prices exclude any tax that may apply to you; where tax is due it is shown at checkout. If we change the price we will tell you at least 30 days before it affects you.
Cancellation
You can cancel at any time and there is no minimum term. See our cancellation and refund policy for what happens to the rest of your billing period.
We may suspend or close an account that is not paid, or that is used to attack or overload the service. If we close your account for any other reason we will refund the unused part of the period.
Liability
To the extent the law allows, our total liability to you in any twelve-month period is limited to the amount you paid us in that period. We are not liable for lost profits, lost business, or indirect losses. Nothing here limits liability that cannot lawfully be limited.
Governing law
These terms are governed by the law of the country in which Black Ember Labs is established, and its courts have jurisdiction. If you are a consumer, this does not remove protections you have under the law of your own country.
